Terms & Conditions

Legal Disclaimer

By booking or using the services of Luxe View Imaging (“Company,” “we,” “our,” or “us”), or by accessing our website, you (“Client,” “you,” or “your”) agree to the following Terms & Conditions. Please read carefully, as they are designed to protect both parties and ensure clarity on media ownership and usage.

1. Services

Luxe View Imaging provides professional photography and videography services, including but not limited to real estate, portrait, and event photography. All deliverables, timelines, and pricing are outlined in the booking confirmation or service agreement.

2. Booking & Payments

  1. A non-refundable deposit of 15% is required to secure your session.

  2. Remaining balances must be paid before or on the day of the session unless otherwise agreed in writing.

  3. Accepted payment methods: PayPal Business, ACH Transfer, or other form of payment agreed upon.

  4. Late payments may incur additional fees and may delay delivery of final media.

3. Cancellations & Reschuduling

  1. Sessions may be rescheduled with at least 3 days’ notice.

  2. Cancellations less than 3 days before the scheduled session will result in forfeiture of the deposit.

  3. If Luxe View Imaging cancels, a full refund will be issued, or the session will be rescheduled at no extra cost.

4. Intellectual Property & Ownership

  1. All photographs, videos, and other media created by Luxe View Imaging are the sole and exclusive property of Luxe View Imaging.

  2. Clients are granted a limited, non-exclusive license to use images and videos for personal or agreed-upon commercial purposes only.

  3. Clients may not:

    1. Sell, license, or reproduce images or videos for any purpose not outlined in the agreement.

    2. Alter, modify, or create derivative works without written permission.

  4. Luxe View Imaging retains the right to:​

    1. Use all media for portfolio, marketing, website, social media, advertising, or other promotional purposes.

    2. Pursue legal action if unauthorized use, reproduction, or distribution occurs.

  5. For social media, clients may post images only as delivered, without modification, watermark removal, or resale.

5. Client Responsibilities

  1. Clients must ensure that locations, properties, or individuals are accessible and prepared at the time of the session.

  2. For real estate photography, properties must be clean, staged, and ready.

  3. Clients are responsible for obtaining necessary permissions or releases for any individuals or locations.

6. Delivery & Editing

  1. Edited deliverables are delivered digitally within 4-7 days, unless otherwise agreed.

  2. Raw/unprocessed files are never released unless explicitly agreed in writing. This does not apply to portrait sessions.

  3. Luxe View Imaging reserves the right to refuse delivery if payment is incomplete or if terms are violated.

7. Liability & Limitations

  1. Luxe View Imaging exercises professional care in capturing and handling media.

  2. Liability for loss, damage, or unusable media due to technical failure or circumstances beyond our control is limited to a reshoot or refund of session fees.

  3. Luxe View Imaging is not liable for any indirect, incidental, or consequential damages, including delays caused by weather, acts of third parties, or other uncontrollable events.

8. Model Release & Publicity

  1. By booking services, clients grant Luxe View Imaging the perpetual, irrevocable right to use images or videos featuring clients, guests, or property for marketing, advertising, portfolio, and promotional purposes, unless a written request to restrict usage is provided prior to the session

9. Governing Law

  1. These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law provisions. You agree that any dispute arising from or relating to the subject matter of these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Greenville, South Carolina.

10. Agreement

  1. By using Luxe View Imaging services, you acknowledge that you have read, understood, and agreed to all Terms & Conditions in full, including ownership, usage rights, and limitations.
